1. Acceptance of Terms
Welcome to Utrippin. These Terms of Service ("Terms") govern your access to and use of the Utrippin website, mobile applications, and travel booking services (collectively, the "Platform") operated by Utrippin, LLC ("Utrippin," "we," "us," or "our").
By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Platform. Please read these Terms carefully before making any travel bookings.
2. Our Role as a Travel Intermediary
Utrippin operates as a travel intermediary and booking platform. We facilitate bookings between you and third-party travel suppliers, including but not limited to:
- Airlines and air carriers
- Hotels, resorts, and accommodation providers
- Car rental companies
- Cruise lines
- Tour operators and activity providers
- Travel insurance providers
Important: We act as an agent facilitating your booking with travel suppliers. The actual travel services are provided by third-party suppliers, not by Utrippin. Your contract for travel services is directly with the applicable supplier, subject to their terms and conditions.
3. Eligibility
To use our Platform, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction)
- Have the legal capacity to enter into binding contracts
- Provide accurate and complete information
- Use the Platform only for lawful purposes
4. Account Registration
You may create an account to access certain features of our Platform. When creating an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password confidential and secure
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
5. Booking Travel Services
5.1 Booking Process
When you make a booking through our Platform, you are making an offer to purchase travel services from the relevant supplier. A binding contract is formed when:
- You receive a booking confirmation from us or the supplier
- Your payment has been successfully processed
- The supplier has confirmed availability
5.2 Pricing and Payment
- All prices displayed include applicable taxes and fees unless otherwise stated
- Prices are subject to availability and may change until booking is confirmed
- Payment is required at the time of booking unless otherwise indicated
- We accept major credit cards and other payment methods as displayed
- Currency conversion rates are indicative and may differ from actual charges
5.3 Traveler Information
You are responsible for ensuring that all traveler information provided is accurate and matches travel documents exactly. Discrepancies may result in denied boarding, entry refusal, or booking cancellation without refund.
6. Cancellations, Changes, and Refunds
6.1 Supplier Policies
Cancellation and change policies vary by supplier and fare type. These policies are displayed during the booking process and are incorporated into your booking. Common policy types include:
- Non-refundable: No refund for cancellations
- Partially refundable: Refund available minus cancellation fees
- Fully refundable: Full refund available (often with time restrictions)
- Free cancellation: Cancel without penalty within specified period
6.2 Processing Refunds
Refunds, when applicable, will be processed according to the supplier's policy and may take 5-10 business days to appear on your payment method. We are not responsible for delays caused by your financial institution.
6.3 Changes by Suppliers
Suppliers may change flight times, hotel assignments, or other booking details. We will make reasonable efforts to notify you of material changes. In case of significant changes, you may be entitled to alternatives or refunds as per the supplier's policy.
7. Travel Documents and Requirements
You are solely responsible for:
- Obtaining valid passports, visas, and travel documents
- Meeting health requirements (vaccinations, COVID-19 protocols, etc.)
- Complying with entry/exit requirements of all countries visited
- Arriving at airports/hotels with sufficient time
- Understanding and complying with airline baggage policies
We are not responsible for denied entry, missed flights, or other issues arising from inadequate travel documentation.
8. Travel Insurance
We strongly recommend purchasing comprehensive travel insurance covering trip cancellation, medical emergencies, baggage loss, and other travel-related risks. Utrippin is not an insurance provider and does not provide travel insurance coverage.
9. Limitation of Liability
9.1 Third-Party Services
We are not liable for the acts, errors, omissions, representations, warranties, breaches, or negligence of any third-party travel suppliers, or for any personal injury, death, property damage, or other damages resulting from travel services provided by third parties.
9.2 General Limitations
To the maximum extent permitted by law:
- Our total liability shall not exceed the fees paid to us for the specific booking
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not liable for force majeure events (natural disasters, pandemics, wars, government actions)
- We are not liable for losses arising from your failure to follow these Terms
9.3 Platform Availability
We do not guarantee that our Platform will be available at all times or error-free. We may suspend or discontinue any part of the Platform without notice.
10. Indemnification
You agree to indemnify and hold harmless Utrippin, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any third-party rights
- Your travel bookings and travel activities
11. Intellectual Property
All content on our Platform, including text, graphics, logos, images, and software, is owned by Utrippin or its licensors and protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.
12. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Make fraudulent bookings or use stolen payment information
- Interfere with the Platform's operation or security
- Scrape, harvest, or collect data without authorization
- Impersonate others or provide false information
- Violate the rights of other users or third parties
13. Dispute Resolution
13.1 Contact Us First
If you have a dispute regarding a booking or our services, please contact us first at support@utrippin.ai. We will make reasonable efforts to resolve your concerns.
13.2 Arbitration Agreement
Any dispute not resolved through customer service shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Florida. You waive any right to participate in class actions.
13.3 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
14. Changes to Terms
We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
15. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy and any booking-specific terms, constitute the entire agreement between you and Utrippin regarding use of the Platform.
